This Privacy Notice (”Notice”) explains how Lowes Foods, LLC (the “Company”) collects, uses, discloses, retains, and protects personal information when you (i) visit the Company’s retail grocery locations (“Stores”), (ii) visit or access websites, mobile websites, mobile applications, and technology platforms (including online ordering platforms) that are owned, operated, or provided by or on behalf of the Company (the “Sites”), and (iii) participate in the Company’s rewards or loyalty programs, subscription services, contact Guest Services, or otherwise interact with the Company (collectively, the “Services”). By using the Sites, visiting the Stores, or requesting or receiving Services, you hereby consent to the Company’s collection and use of your information as described herein.

Information Collected. Information (which may include some personal information) about you that is collected by the Company directly from you includes, but is not limited to the following (hereinafter referred to as “User Information”):

• Name, postal address, email address, and phone number;
• Payment or financial information;
• Communication records regarding interactions with our Guest Services teams;
• Transaction information, including, without limitation, purchasing records, preferences, merchandise choices or shopping characteristics and history;
• Internet activity, identifiers, or location information, including, without limitation, device type, IP address, use or interaction with the Sites, session behavior, web browser type, dates, times, and locations of actions, and browsing or search history including without limitation merchandise or content viewed or downloaded, by using cookies, web beacons, session replay, in-store tracking technologies (including without limitation Wi-Fi and video surveillance) or other tracking technology, and by using the Sites or visiting the Stores, you expressly consent to the deployment of such technologies and the collection of this information;
• Information from third parties providing information (including but not limited to social media platforms) is subject to each third party platform’s privacy policy.

Use of User Information. The Company maintains, discloses, uses, and shares User Information as provided below. The Company does not control the privacy policies or practices of third parties and is not responsible for the information they may collect or the content of their sites. You should review the specific privacy policies of third parties for more information.

• Service Delivery: Provide, operate, process, or complete the Sites or Services; identify or verify proper access to data and functions within the Sites; communicate with or contact you as necessary to provide the Services, customer support, or answer questions; and for the purpose for which you are providing the information;
• Marketing and Loyalty Programs: Manage participation in the Fresh Rewards loyalty program, including without limitation analyzing purchase history and behaviors to provide tailored discounts; present relevant or personalized marketing, promotions, coupons, surveys, and advertisements; and enable third-party marketing providers to conduct analytics, create modeled audiences, and deliver personalized marketing;
• Operations and Analytics: Legitimate business purposes including without limitation enhancing or developing business operations; engaging third-party service providers (e.g., analytics, fraud prevention); conducting research, market analysis, or product enhancement; and creating Guest profiles reflecting purchase history, behavior, and demographics;
• Legal and Security: As required by law, regulation, court order, or legal requirement; protect the rights or property of the Company, its employees, Guests, or partners; prevent harm or respond to emergencies; investigate illegal activities; and establish, exercise, or defend the Company against legal claims.

Opt-Out. You may choose not to provide information when requested; however, in the event you choose not to provide the requested information (which may include personal information), you may not be able to utilize certain features, functionality, or offerings available in-Store or from the Sites or Services.

By subscribing to SMS/text messaging, you agree to receive marketing and/or promotional text messaging that includes messages about offers and updates from the Company at the mobile number submitted when opting in (for more information please visit the Terms and

Conditions). You have the following options regarding your User Information:

• Opt-out of receiving marketing and advertising promotions or the sharing of your User Information,
• Correct and update your User Information, or
• Cancel your account.

To opt out of receiving marketing and advertising promotions via email, please follow the “Unsubscribe” link in the email communication provided from the Company. To opt out of direct mail marketing, the sharing of your User Information with third parties, or to request a copy of or deletion/erasure of your User Information please call Guest Services at 1-888-537-8646 (Mon-Sun, 8am-5pm EST) or email wecare@lowesfoods.com. To opt out of SMS/text messaging reply “STOP” in response to an SMS/text message received from the Company at any time. For help regarding SMS/text messaging, text “HELP” in response to an SMS/text message received from the Company, call the Company’s Guest Services phone number at 1-888-537-8646 (Mon-Sun, 8am-5pm EST, or email wecare@lowesfoods.com. Message and data rates may apply to SMS/text messaging, and frequency may vary. To correct or update your User Information, please login to your account to edit your profile. You can also visit an in-Store kiosk.

Retention. Subject to limits imposed by applicable law, the Company reserves the right to retain your User Information for any reasonable business purpose or as reasonably useful or needed until such time that the Company, in its sole discretion, decides to remove such data, even in the event you elect to cancel your account or opt out of marketing communications. The Company reserves the right to remove User Information at any time from its records as appropriate in the sole discretion of the Company.

Security. The Company uses administrative, technical, and physical safeguards designed to protect personal information based on the nature of the personal information and the risks associated with its use. These safeguards are intended to help protect personal information against unauthorized access, use, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and the Company cannot guarantee absolute security of any information. If the Company becomes aware of a security incident involving personal information, the Company will evaluate and respond in accordance with applicable law and the Company’s applicable incident response processes.

AI and Automated Processing, The Company may use analytics, automated tools, or Artificial Intelligence (“AI”)-supported technologies to help personalize offers, improve Services, detect fraud, support Guest Services, or improve operations. Where required or appropriate, the Company provides additional information or choices.

Transferability. In the event the Company goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your User Information may be among the assets transferred. You will be notified by means of a notification posted on this Site for at least thirty (30) days of any such change in the ownership or control of your User Information.

Child Privacy Protection. The Company does not knowingly collect information about children under the age of thirteen (13) years old. Parents or guardians who believe that a child has provided personal information without their consent should contact the Company’s Guest Services at 1-888-537-8646. If the Company becomes aware that a child under the age of thirteen (13) has provided information, such information will be deleted.

Governing Law. The Company’s Sites and Services are provided solely to those persons, users, and customers in the United States of America (the “U.S.”) and are not geared towards individuals located outside of the U.S. This Notice is governed and controlled by and will be construed in accordance with the laws of the State of North Carolina, which may have different data protection rules than other jurisdictions. Changes and Updates. The Company reserves the right to change this Notice at any time. It is your responsibility to check back from time to time, so you are aware of any changes or updates. The effective date of this Notice will be indicated at the top of the page. By continuing to use any Sites or Services after the posting of any such changes, you accept and agree to the Notice as modified.
