Information Collected. Lowes Foods collects a range of information from you when you use the Sites or Services or visit our retail grocery locations (“Stores”). In order to use all of the functionality of the Sites, Services, or in-store shopping benefits, you may be asked to provide personal information. Information about you collected by Lowes Foods includes, but is not limited to the following (hereinafter referred to as “User Information”):

• Name, address, email address, and phone number;

• Payment or financial information;

• Communication records regarding interactions with our Guest Services teams;
• Transaction information, including, without limitation, purchasing records, preferences, merchandise choices or shopping characteristics;
• Internet activity, identifiers, or location information, including, without limitation, device type, IP address, use or interaction with the Sites, web browser type, dates, times, and locations of actions, and merchandise or content viewed or downloaded, by using cookies, web beacons, or other tracking technology;
• Information from third-party sources, including but not limited to that provided by social media platforms, which is subject to that platform’s privacy policy.

Use. Lowes Foods collects, maintains, discloses, uses, and shares User Information as provided below. Lowes Foods does not control the privacy policies or practices of third parties and is not responsible for the information they may collect or the content of their sites. • Provide, operate, process, or complete the Sites or Services;
• Legitimate business purposes and to enhance or develop business operations;
• Identify or verify proper access to the data and functions within the Sites;
• Communicate with or contact you as necessary to provide customer support, answer questions, or other communications;

• To enable third party marketing providers including, without limitation, Oracle, to conduct offline and online campaign measurement, analytics, and development of insights, create modeled online and offline audiences for Lowes Foods products and services, allow Lowes Foods to deliver catalogues to physical address based previous purchase behavior, to enable Lowes Foods to personalize products and Services, including site optimization, email personalization and dynamic marketing, and advertising optimization;
• Research, market analysis, or product enhancement;
• As required by law, regulation, court order, or other regulatory requirements;
• Protect the rights or property of Lowes Foods, its employees, Guests, or other individuals, entities, partners, affiliates, providers, or licensors;
• Prevent harm or loss or respond to an emergency situation;
• In connection with actual or suspected illegal activities and investigations thereof.

Opt-Out. You may choose not to provide information when requested; however, in the event you choose not to provide the requested information, you may not be able to utilize certain features, functionality, or offerings available from the Sites, Services, or in-store. By subscribing to SMS/text messaging, you agree to receive marketing and/or promotional text messaging that includes messages about offers & updates from Lowes Foods at the mobile number submitted when opting in (for more information please visit the Terms and Conditions). You have the following options regarding your User Information:

• Opt-out of receiving marketing and advertising promotions or sharing of your User Information,
• Correct and update your information,
• Request a copy of, deletion or erasure of your data, or
• Cancel your account.

To opt out of direct mail marketing, the sharing of your User Information with third parties, or to request a copy of or deletion/erasure of your User Information please call Lowes Foods Guest Services at 1-888-537-8646 or email wecare@lowesfoods.com. Retention. Subject to limits imposed by applicable law, Lowes Foods reserves the right to retain your User Information for any reasonable business purpose or as reasonably useful or needed until such time that Lowes Foods, in its sole discretion, decides to remove such data, even in the event you elect to cancel your account or opt out of marketing communications. Lowes Foods reserves the right to remove User Information at any time from its records as appropriate in the sole discretion of Lowes Foods.

Security. Lowes Foods maintains physical, electronic, and procedural safeguards designed to protect your nonpublic information and uses various virus protection, firewalls, and activity logs as additional security mechanisms. While Lowes Foods takes various security measures to protect the privacy of any information you submit, we cannot guarantee that computer hackers, security failures, or other attacks will not compromise your User Information.

Transferability. In the event Lowes Foods goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your User Information may be among the assets transferred. You will be notified by means of a notification posted on this site for at least thirty (30) days of any such change in the ownership or control of your User Information.

Child Privacy Protection. Lowes Foods does not knowingly collect information about children under the age of thirteen (13) years old. Parents or guardians who believe that a child has provided personal information without their consent should contact Lowes Foods Guest Services at 1-888-537-8646. If Lowes Foods becomes aware that a child under the age of thirteen (13) has provided information, such information will be deleted.

Governing Law. Lowes Foods services are provided solely to those persons, users, and customers in the United States of America (the “U.S.”) and is not geared towards individuals located outside of the U.S. As such, this policy is governed by and construed in accordance with the laws of the State of North Carolina, which may have different data protection rules than other jurisdictions.

Changes and Updates. Lowes Foods reserves the right to change this Privacy Policy at any time. It is your responsibility to check back from time to time, so you are aware of any changes or updates. The effective date of this policy will be indicated at the top of the page. By continuing to use any Sites or Services after the posting of any such changes, you accept and agree to the Privacy Policy as modified.
